Terms of Service


GbSpace Web Hosting Terms Of Server (TOS), is provided to give our clients an understanding of what GbSpace Web Hosting expect of them while using our web hosting service. We reserve the right to persue criminal charges, in the event of misconduct on our servers.

Content

All services provided by GbSpace Web Hosting, may be used for lawful purposes only. Accounts that fail to correspond with our agreement will be suspended, until the problem is corrected. Failure to correct the problem, will result in account termination. The following conditions below are against our terms of service, customers found to be abusing our content restrictions will be terminated.

ANY Pornographic and or sex related merchandising is prohibited on all services provided by GbSpace Web Hosting. This includes sites that offer sexual content, or link to adult content elsewhere.

Sites that contain or link to other sites with illegal activity will be suspended, this includes but is not limited to warez, hacking, MP3's, privacy violations, obscenity, IRC scripts, pirated software and copyrighted material.

Sites that intentionaly abuse system resources, will be disabled, until the matter is corrected, this includes but is not limited to hosting scripts, images, software with intent to reduce load on another webhost.

Spam

Spamming, or the sending of unsolicited email (Junk Mail, Bulk Mail, Spam), from a server maintained by GbSpace Web Hosting, is strictly prohibited. Accounts that violate our spamming policy will be suspended without notice, your account may also be terminated based on the severity of spam. Email in bulk form may only be sent if a user specifically requested i, such as a newsletter, in this case a Working URL must be provided to the user in order to remove himself/herself from your mailing system. Accounts abusing our Spam policy may be subject to pay a $450 fee, for network/server cleanup purposes, depending on the circumstances.

Web Based Communication

Web Based Message Boards & Chat Rooms that drain system resources, may be suspended to correct this problem. To avoid this, please use Message Boards & Chat rooms written in a non-perl environment.

Scripts

Customers may install custom scripts on their accounts, however customers who install exploitable scripts will have their accounts suspended until this problem is resolved. We urge you to research a script or contact us before you deceide to install it, so we can verify it is okay to install. Customers who install scripts that abuse or overuse system resources will also be suspended until the problem is corrected.

IRC

We do not allow IRC servers or IRC bots to be operated on our servers. This will result in account suspension until the problem is corrected.

Reseller Accounts

As an added service GbSpace offers Reseller Accounts to our customers, with the intent for our customers to operate their own web hosting company, not to be used to give away Free Web Hosting. While we do allow Resellers to give away free web hosting, the limit of free accounts is 30. Resellers may host an unlimited amount of paying customers on our servers, the domain restriction only applys to free web hosting accounts. As a reseller, you and your customers, must abide to our Terms Of Service, we reserve the right to suspend/terminate your customers for abusing our Terms Of Service. Your customers, are not our responsiblity.

Criminal Charges

Sites which contain Child Pornogrophy, Ebay Scams, Credit Card Scams/Fraud, or anything else against federal/state laws in the United States of America, is strictly prohibited on our servers. If sites on our servers, are found to be abusing this agreement we reserve the right to press criminal charges and or submit your website data, contact information or any data which we have on file to the FBI or the appropriate authorities.

Server Abuse

Attempts to cause harm to a server, or customers/accounts is strictly prohibited, persons who violate this rule will be terminated without notice.

System Resources

Customers who are overusing system resources, will be notified in order for them to make changes to reduce the load on our servers, customers who do not abide or make the changes required, may be suspended until further the problem is corrected.

Limitation Of Liability

GbSpace Web Hosting, will not be responsible for any claimed damages, including incidental and consequential damages, resulting from a server going off-line, being unavailable for any reason or account termination.

GbSpace Web Hosting, will not be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning.

Uptime

GbSpace Web Hosting, guarantees an uptime of 99.8%, downtime does not include scheduled maintenance or server hardware upgrades, as this is absolutely nessisary. If we do not reach 99.8% uptime during any given month, we will partially refund your monthly payment, based on the following refund system. We will refund $1 per each percent lower than our guaranteed uptime.

Stored Data

GbSpace Web Hosting, schedules multiple data backups weekly, we do not guarantee that any recent changes made to your website will be available for backup purposes. It is important that anytime you change settings/website, that you backup your own data. We will not be held liable for any data lost.

Account Activation/Termination

By activating your account with GbSpace Web Hosting, you agree to the above Terms Of Service. Failure to follow these guidelines will result in account suspension, and possibly termination. If you request a refund, and did not follow our terms, no refund will be issued. We will contact you before any action is taken, so you will have the chance to solve the matter, if the problem is not resolved within 24 hours, we reserve the right to remove your website/sites from our servers. GbSpace web Hosting, reserves the right to modify this agreement at any time.
